The online marketplace seems to have just about anything you could possibly want, and whatever you buy can usually be delivered to you in 24 to 48 hours. Yet Amazon doesn’t (and shouldn’t) necessarily carry everything – and that includes CBD gummies.

Although the United States has legalized the production of hemp, the natural compounds extracted from hemp – like cannabidiol (CBD) – aren’t regulated by the Food and Drug Administration (FDA). Between FDA rules and state laws on how CBD can be marketed and packaged, selling CBD on an international global marketplace can be complex. It isn’t surprising, then, that Amazon forbids the sale of CBD products (including gummies) on its site.

Some companies have tried to get around this rule by selling CBD products that are labeled as “hemp” instead. Unfortunately, when buying hemp gummies or similar items on Amazon, it can be difficult (or even impossible) to know what you are getting. The 2018 Farm Bill legalized the production of hemp in the United States. Under this law, it is now legal for farmers to cultivate and grow the hemp plant, provided that the harvested hemp contains no more than 0.3% THC (the psychoactive compound in marijuana that makes you feel high). This law effectively made hemp into an agricultural crop and removed it from the federal government’s list of controlled substances.

Before hemp was demonized in the early 1900s – largely due to racism against Mexican immigrants who used marijuana recreationally – it was an important crop throughout the United States. Hemp was used for the production of rope, sails, and clothing, and was even exchanged as legal tender in the colonies. Hemp continues to have a number of uses, including bioplastics, insulation, biofuel, and paints.

Hemp is also a food product. Hemp seeds are highly nutritious, and a great source of essential fatty acids. Hemp oil, which is made from the seeds of the hemp plant, is also a nutritional superstar.

So why was hemp considered a controlled substance in the United States? Its inclusion on this list was largely due to the fact that the cannabis sativa plant produces both hemp and marijuana. When lawmakers sought to ban the use of recreational marijuana, they included hemp. For decades, this decision prevented Americans from reaping the many beneficial uses of hemp – including CBD products.

CBD is a naturally-occurring compound found in the stalks and leaves of the hemp plant that has a number of health and wellness benefits. While CBD won’t get you high or make you feel stoned, preliminary research has indicated that it can help with a number of conditions, from anxiety to chronic pain to insomnia.

Products derived from hemp – like CBD gummies – are legal in all 50 states, provided that they contain no more than 0.3% THC. While CBD products do not require FDA approval, this federal agency has specific guidelines about how CBD can be marketed. Specifically, the FDA and another agency, the Federal Trade Commission, have warned companies to not market CBD using unsubstantiated claims (a common tactic used by CBD scam companies).

Federal law also prohibits selling food that contains CBD. While the FDA is expected to soften its stance on CBD in food items, many manufacturers of CBD products are careful about how they package and market their edible products (like CBD gummies) to avoid violating the law.

The bottom line? The laws regarding CBD are both complex and evolving. With this in mind, it perhaps isn’t surprising that a mega retailer like Amazon has chosen to stay out of the CBD game entirely.

Does Amazon Sell CBD Gummies?

Amazon restricts the sale of certain products on its site for both legal and practical reasons. Its list of restricted products includes items like tobacco, live animals, and alcohol. Amazon’s policy also forbids the sale of dietary supplements that contain a controlled substance.

As noted above, CBD that is derived from American-grown hemp is not a controlled substance. While marijuana is still considered a controlled substance, hemp that contains less than 0.3% THC is not. Products made from hemp – like CBD oil extracted from the hemp plant – are not controlled substances.

Despite this reality, Amazon has chosen to ban the sale of CBD on its site. This decision is based more on practicalities than the law. With hundreds of thousands (or even millions!) of products available for sale, it is far easier for Amazon to avoid potential legal issues by forbidding the sale of CBD products.

Of course, many people view rules like this as more of a hoop to jump through than a strict limit. To get around this prohibition, sellers often market their CBD products in other ways. Most often, CBD products will be sold as hemp or hemp oil products on Amazon.

According to an investigation by the Washington Post, many of the hemp products sold on Amazon actually contain CBD. Its journalists purchased 13 separate products marketed on Amazon as hemp products, including “hemp gummies.” Independent testing found that 11 of these products contained CBD – and one had a small amount of THC. Neither CBD nor THC were listed as ingredients on Amazon.

So what does this mean for consumers? While you can technically purchase CBD gummies on Amazon, you will never know exactly what you are getting. Many CBD retailers are attempting to circumvent Amazon’s rules by changing their packaging or omitting ingredients like CBD on their listing.

This practice may allow them to sell on Amazon – but it leaves you in the dark when it comes to buying CBD gummies. When you click “buy now,” you have no real way of knowing if the product that you just bought will contain CBD at all. It also makes it incredibly difficult to determine exactly how much CBD you are getting per serving, if there is any THC present in the product, or if there are any impurities.

The upshot? Buying CBD gummies (or any CBD product) on Amazon isn’t a great idea. Instead, you should look for a site where you know that you’ll get safe, effective CBD gummies – without all of the subterfuge and hidden ingredients that you deal with on Amazon.
